Desktop Metal Says Court Approves Motion for Expedited Trial in Suit Against Nano Dimension

Desktop Metal (DM) said Friday that the Delaware Court of Chancery has approved its motion for an expedited trial in a lawsuit that the company filed on Dec. 16 against Nano Dimension (NNDM).

Desktop Metal alleges in the suit that Nano Dimension has breached obligations under a merger agreement between the companies to get regulatory clearance and close the deal as soon as possible, the company said.

The trial is now expected to be scheduled for the week of Feb. 24, Desktop Metal said.

Desktop Metal also said Friday that on Dec. 31 it filed a second suit against Nano Dimension in the Court of Chancery. The second suit alleges that Nano Dimension's September agreement to buy Markforged (MKFG) -- if it materializes -- would violate Nano Dimension's obligation in the merger agreement to not close acquisitions that would increase the risk of a government entity blocking or delaying the merger, the company said.

The second suit also names Markforged as a defendant, Desktop Metal said.

Desktop Metal shares were rising 6.3% in recent trading and Nano Dimension was up 0.4%.

Nano Dimension and Markforged didn't immediately respond to requests for comment by MT Newswires.
