AudioEye said Tuesday that the Supreme Court of the State of New York dismissed a lawsuit brought by former employee David Kovacs against the company, Chief Executive David Moradi, and Chairman Carr Bettis.

The maker of accessibility technology for disabled people said the lawsuit, which included claims of stock manipulation, retaliation and intentional infliction of emotional distress, was dismissed with prejudice, and cannot be refiled. Kovacs had already dropped claims of "defamation and tortious interference," the company said.

Kovacs had claimed that he was laid off by AudioEye for refusing to participate in an insider-trading scheme.

AudioEye has sued Kovacs in Florida, alleging defamation and other causes of action.

Shares of AudioEye rose 2.4% to $19.24 premarket, and have more than tripled in value over the last 12 months.
