这已是强生第三次尝试通过破产策略解决相关诉讼，但均以失败告终。法官洛佩兹在裁决中明确指出，强生公司"本就不应进入破产程序"。他认为，强生的和解方案未获得足够多患癌女性的支持，且过度豁免了未申请破产实体的法律责任，包括强生产品经销商及2023年分拆的消费者健康业务Kenvue。
面对这一裁决，强生表示不会上诉，但也拒绝继续和解。公司计划"回归侵权法体系，通过诉讼击败这些毫无根据的滑石粉索赔"。强生全球诉讼业务副总裁Erik Haas在一份声明中表示："我们决定对每一宗诉讼都提起诉讼，原因很简单，那就是这些是贪婪的原告律师捏造的虚假指控。"
