智通财经APP获悉，周三，美国西北大学(Northwestern University)在特拉华州联邦法院对Moderna(MRNA.US)提起了一项新的专利诉讼，指控该公司滥用该校的创新成果来开发其重磅的新冠疫苗Spikevax。
该诉讼称，Moderna在Spikevax疫苗中未经许可使用西北大学开发的脂质纳米颗粒(LNP)技术，将脆弱的mRNA运输到人体内。
Moderna的一位发言人表示，该公司得知这起诉讼，并将针对这些指控进行辩护。西北大学的律师和发言人没有立即回应置评请求。
这起诉讼是辉瑞(PFE.US)、BioNTech(BNTX.US)和Moderna在新冠疫苗中涉及使用的技术专利使用费问题上的一系列美国法院诉讼的一部分，其中包括Moderna在2022年对辉瑞提起的诉讼。周二，英国制药公司葛兰素史克(GSK.US)在特拉华州的同一家法院起诉Moderna，称其在新冠病毒和呼吸道合胞病毒(RSV)疫苗中滥用公司的LNP技术。
西北大学表示，其研究人员在2009年和2010年率先使用LNP将mRNA递送到人类细胞中。该大学的诉讼称，Moderna的Spikevax中的LNP与其专利技术的工作方式相同。
该校的投诉称，“如果没有借鉴包括西北大学在内的先前研究人员的技术突破”，Moderna不可能在开发疫苗方面取得“快速进展”。
西北大学要求法院就Moderna的侵权行为赔偿包括版税在内的金额不详的经济损失。据悉，Moderna去年从Spikevax实现了67亿美元的营收。
