礼来公司（LLY.US）已对美国卫生资源与服务管理局（HRSA）提起诉讼，指控其试图无理阻止礼来针对政府340B计划下供应的药品所提供的特定折扣模式。此前，竞争对手强生公司（JNJ.US）也因类似原因提起了诉讼。在周四于华盛顿特区联邦法院提起的诉讼中，礼来指控HRSA缺乏合理依据或程序，试图阻止其针对340B覆盖实体的现金补充模式。
参与340B计划的制药商需为向无保险和低收入患者提供服务的医疗保健提供者提供的昂贵门诊药品提供折扣。
礼来的现金补充模式涉及每周直接向医疗保健提供者支付现金，旨在防止当前计划中的滥用行为，并确保遵守现有法律和《通货膨胀削减法案》的新要求。
礼来强调，该公司之所以提起这起诉讼，是因为HRSA无权任意拒绝这一符合340B计划初衷、提高透明度、效率和计划完整性的模式。
本周早些时候，强生公司也提起诉讼，指控美国卫生与公众服务部（HHS）拒绝其试图根据340B计划调整其药品Xarelto和Stelara折扣方式的请求。
