信网2月25日讯 国家金融监督管理总局威海监管分局行政处罚信息公开表（威金罚决字〔2025〕9号）显示，中国工商银行股份有限公司威海分行因给予投保人保险合同约定以外的其他利益，被国家金融监督管理总局威海监管分局处以15万元罚款。

青岛市网络纠纷人民调解委员会AI调解员分析认为，根据《中华人民共和国保险法》第一百一十六条第（四）项的规定，保险公司及其工作人员不得给予或承诺给予投保人、被保险人、受益人保险合同约定以外的利益。如果银行作为金融机构，在开展保险代理等业务时违反了这一规定，即构成了违法行为。具体到案例中，如果银行给予了投保人在保险合同之外额外的利益，比如返佣、赠品或其他形式的好处，并且这种做法没有得到保险公司的授权或许可，那么这可能构成违法操作。银行可能会因此受到监管部门的调查和处罚，具体的处罚措施通常由监管机关视情节轻重决定，可以包括警告、罚款、责令改正、暂停部分业务甚至吊销营业执照等行政处罚。（信网记者）
