智通财经APP讯，五矿资源(01208)发布公告，该公司欣然宣布，MLB(Minera Las Bambas S.A.)已收到秘鲁税务法院的有利判决，裁定MLB有权(i)就2018年税务年度申索税务亏损4.29亿美元;及(ii)从中国贷款银行组成的银团获得的3.78亿美元贷款及从MLB股东MMG Swiss Finance A.G.于2018年获得的2.42亿美元股东贷款取得利息扣减。
2014年至2018年的重列税务亏损为25.75亿美元。
2018年的所得税评估金额9.12亿美元已被税务法院减至0美元，理由与之前公布有关税务法院就有关2017年所得税评估的判决准则相似，即所得税法规仅旨在防止逃税情况，唯本案件并不适用，且关联方条例不能仅因公司与国家的关系而适用于国有企业(即中国贷款银行)。SUNAT的负资产论点亦被驳回，因为双方(即MLB及中国贷款银行)并无关联。关于因果关系原则，税务法院认为股东贷款可予扣除，因为贷款的最终目的与收购Las Bambas有关。
截至目前，MMG所公布的税务法院判决的积累效果，已消除就SUNAT所声称的所得税、利息和罚款支付20.16亿美元的不确定性。
目前尚未确定SUNAT是否有意就该判决提出上诉。公司据知于秘鲁税务行政司法系统进行上诉或需时多年方可解决。
