Medibank Private (ASX:MPL) said that Australia's Federal Court held that the reports prepared by Deloitte were not subject to legal professional privilege and upheld Medibank's claims to legal professional privilege in respect of the remaining third-party reports and correspondence, according to a Friday Australian bourse filing.
Medibank applied for leave to appeal the decision in relation to the reports by Deloitte.
A class action lawsuit was filed with the court in May 2023 seeking compensation for consumers impacted by a data breach in October 2022, alleging that Medibank breached privacy and consumer laws as well as data retention laws.
Medibank had earlier claimed that a Deloitte report into the data breach was not relevant to the legal action.
Medibank Private's shares rose almost 1% in recent trading on Friday, earlier reaching an all-time high.
