开庭陈述将于美国东部时间周二上午9:30开始(1330 GMT)，由曼哈顿的美国地区法官杰德-拉科夫（Jed Rakoff）主持。
拉科夫和双方律师选出的九人陪审团包括五名女性和四名男性。
佩林起诉该报的起因是该报于2017年6月14日发表了一篇社论，标题为 "美国致命的政治"，错误地暗示她可能煽动了2011年1月在亚利桑那州一个停车场发生的大规模枪击事件，该事件造成6人死亡，美国众议员加比-吉福兹（Gabby Giffords）受重伤。时报》很快更正了社论并道歉。
