Atlas Arteria (ASX:ALX) said Toll Road Investors Partnership II filed a complaint with the federal court alleging violations of the Virginia and US constitutions by the Commonwealth of Virginia, as well as the State Corporation Commission and its commissioners, alleging among other things, constitutional violations arising from the taking of private property for public use without just compensation, according to a Monday Australian bourse filing.
The Toll Road Investors Partnership II is a limited partnership that owns the concession to operate the Dulles Greenway, a toll road in Virginia, wholly owned by Atlas Arteria.
The partnership is seeking compensatory, declarative, injunctive, punitive, and other relief.
